RE: The tariff classification of gloves from China.
Dear Ms. Black:
In your letter dated February 1, 2013, you requested a tariff classification ruling on behalf of your client, Tenacious Holdings. The sample submitted will be returned.
Style 920 is a nitrile dipped, string-knit glove constructed of 100% cotton. The nitrile covers the entire palm as well as a portion of the palmside cuff and overlaps the backside fingertips and sides of the wearer’s hand and fingers. Affixed to the backside are thermoplastic rubber molds which are designed for impact protection. The glove features an elasticized cuff and an overlock stitch finish at the cuff bottom. You have indicated that the weight of the textile fibers is less than 50% of the weight of the glove.
The applicable subheading for style 920 will be 6116.10.6500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: without fourchettes: other: other. The duty rate will be 7% ad valorem.
You assert that the proper classification of this glove should be 6116.10.5510, HTSUS, which provides for gloves, mittens, mitts, knitted or crocheted; impregnated, coated or covered with plastics or rubber; other; without fourchettes; other; containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers; subject to cotton restraints; however, this tariff number does not apply because this style does not contain 50 percent or more by weight of textile fibers.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
